Energy measure foes file lawsuit

Opponents of a measure that seeks to break up NV Energy’s monopoly and deregulate electricity markets are suing to keep it off the Nevada ballot.

The lawsuit filed Thursday in Carson City District Court says the Energy Choice Initiative, which is also called Question 3, unlawfully ties the hands of the Legislature going forward. Plaintiffs are Jacqueline Bird and Gail Tuzzolo.

The AFL-CIO launched a formal campaign against the measure, which is backed by the Las Vegas Sands, MGM Resorts and Switch. Tuzzolo has been heavily involved with the labor group.

Question 3 directs lawmakers to open electricity markets but must pass two consecutive statewide votes to become part of the state’s constitution.

Polls show the measure has popular support.
