Murder defendant arrested in theft

One of the defendants awaiting trial in a 1998 Carson City murder was arrested early Wednesday morning for allegedly stealing two 18-packs of beer from a gas station.

Clinton Malone, 19, was charged with misdemeanor suspicion of petty larceny, minor consuming, contributing to the delinquency of a minor and obstructing.

Carson City Sheriff’s Department deputies were patrolling in the 700 block of South Carson Street when they saw a gold vehicle parked behind the AM/PM with two girls inside, police reports state.

As officers were looking at the car, two men walked out of the AM/PM, one carrying two 18 packs of Budweiser beer.

The report states when the man saw police he turned around and went back inside the store.

A clerk told the police the two men had just stolen the beer, the report states.

“The smaller (male) later identified as (Malone), took off running,” the deputy wrote in the report.

He said with the assistance of Carson Station security, Malone was taken into custody.

“He refused to give his name and was finally identified by jail staff,” the deputy said. “Malone was highly intoxicated and was trying to kick the back window out of the car.”

The two girls in the car, both 17, told officers they’d been drinking all evening with the men.

Malone is one of 10 people who stand accused of the 1998 motel-room beating death of Sammy Resendiz.

Resendiz, 25, was brutally beaten at the Round House Inn on Aug. 23, 1998, and suffered numerous broken bones and head trauma before dying at the hospital a few hours later.

A trial date of July 22 has been set for Frederick Fred, Lew Dutchy, Rocky Boice Jr. and Malone.
