Trial dates set for all in 1998 murder

Trial dates for the remaining nine of 10 defendants who stand accused in a 1998 beating death have been set Monday.

Four of the defendants will be tried in two trials between Oct. 4 and Dec. 20, and the remaining five will be tried in two trials between Feb. 10 and March 23.

Defendant Rocky Boice Jr., 25, is scheduled to be the first to go to trial Aug. 26 on charges of open murder, burglary and battery with the use of a deadly weapon in the beating death of Sammy Resendiz Aug. 23, 1998 at the Round House Motel.

A court date for Julian Contreras, 19, is set for Oct. 21 to Nov. 11.

Jaron Malone, 21, Jessica Evans, 24, and Fred Fred, 23, are scheduled to be in court Dec. 2 to Dec. 20.

There are no trials in January.

On Feb. 2, an 18-day trial has been set for Clint Malone, 19, and Lew Dutchy, 27.

Silvia Fred, 21, Michael Kizer, 18 and Elvin Fred, 20, will appear for the final trial March 3 to March 28.

In all, more than 500 residents will be called for jury selection.

Of the original 12 suspects, two have pleaded guilty and received suspended sentences. Alejandro Avila pleaded guilty to gross misdemeanor conspiracy to commit murder and David Moyle pleaded guilty to conspiracy to commit battery with a deadly weapon. Both men are expected to testify for the prosecution.
