Federal court hearing set for Friday on BLM land

A federal court hearing has been scheduled for Friday to determine if a temporary restraining order will be issued to stop a scheduled Aug. 6 auction of a public parcel in northern Douglas County.

The hearing will allow federal government lawyers representing the U.S. Department of the Interior and the Bureau of Land Management to make their case against stopping the sale.

Carson City's lawyer in Washington, D.C., filed a request with the U.S. District Court there for a preliminary injunction to halt the auction of 144 acres by BLM. Friday's hearing may decide whether judges will issue a temporary stop to the sale while the court rules on the injunction request.

The injunction would stop the sale until Carson's lawsuit against the federal government is decided.

"I don't know how it's going to go," said Mark Forsberg, Carson's deputy district attorney.

The court has the option to rule on the injunction Friday, Forsberg said. The federal government's lawyers have five days to prepare a response to the injunction. The deadline for the response is Thursday.
