A convicted Oregon sex offender was arrested Thursday afternoon in Carson City for allegedly violating his probation just eight days after he had his case transferred to Nevada.
Mitchel Marlin Burns, 42, was booked into the Carson City Jail about 2 p.m. on three unspecified felony probation violations.
Burns was originally arrested in Carson City in November 2005 on an Oregon warrant charging two counts of felony first-degree unlawful sexual penetration, two counts of first-degree sodomy and two counts of first-degree sexual abuse in repeated assaults on a 4-year-old girl.
After more than a year in custody in Salem, Ore., he pleaded guilty Feb. 8 to two counts of attempted sexual penetration and two counts of attempted sexual abuse of a child, according to Marion County Deputy District Attorney Charlyn Rees of Salem. Burns was sentenced to five years' probation, with a suspended prison sentence of seven years.
Nevada Parole and Probation Northern Command spokesman Rich Teran said Burns returned to Carson City on Feb. 28 and was living at Roop and Long streets under intensive supervision by Parole and Probation. Teran was not able to reveal the violations that resulted in Burns' arrest by probation officers Thursday.
He said the case will be forwarded to Oregon for review.
"Oregon Interstate Compact authorities will review the violations and they will make a determination whether or not to order him back to answer to the allegations of probation violation," Teran said. Burns will remain in Carson City Jail until Oregon makes a decision.
