Female guard in prison sex case fired

The female guard who admitted to a sex act with a fellow officer has been terminated after the state won summary judgment in her case.

Amie Bianchini and Sean Hoferer both admitted she performed oral sex on him while they were on the night shift at Lovelock Correctional Center in February 2005. He resigned, but she contested the firing and won reinstatement by Hearing Officer Pat Dolan.

Dolan agreed the conduct was disgraceful but ruled the evidence failed to establish her conduct warranted firing.

The Nevada Attorney General's Office petitioned Carson District Court to overturn Dolan's ruling, arguing it was a clear abuse of discretion. Then prisons director Glen Whorton said Nevada shouldn't have to tolerate that kind of conduct by state employees on duty.

When Bianchini failed to respond to the petition, the state filed for summary judgment in the case.

The motion was filed in August, and according to court records, Bianchini never responded in the case. The motion for summary judgment overturning Dolan's reinstatement ruling was granted. Prison officials say Bianchini has been formally terminated from state service for her conduct.
