Lyon County considers settlement with Traditions developer

The Lyon County Commission on Thursday will consider a settlement agreement for a lawsuit filed by Reno developer Stan Lucas pertaining to the Traditions Village Subdivision in Dayton.

Lyon County would waive depreciation payment from Lucas in the total of $200,801.44 and agree to pay Lucas $25,000 to resolve all claims, and the county will receive $75,000 to offset the waiver.

According to staff reports, Lucas originally applied for a zoning map amendment and tentative map for the “Cottages at Traditions” in 2021, intended to be a zoning designation permitting single-family homes, and through the tentative map, Lucas had indicated development of the 43-unit Cottages at Traditions project.

In March 2021, the Lyon County Planning Commission approved the zoning change and tentative map. On April 1, 2021, the Lyon County Board of Commissioners approved the zoning amendment and denied the tentative map.

On April 23, 2021, Lucas filed a petition for review in the Third Judicial District Court on the denial and filed a civil complaint. He sought damages against Commissioners Wes Henderson, Vida Keller, Ken Gray, Robert Jacobsen and Dave Hockaday based on their vote to deny the Cottages at Traditions tentative map.

On Oct. 1, 2021, District Judge Leon Aberasturi entered his order in the petition and mandated approval of the tentative map, and following the decision, the board approved the map ending the petition. However, the civil complaint between the parties continued.

Lucas and the county commission have continued in settlement discussions, which resulted in mediation with retired District Court Judge David Gamble on Jan. 23. Subsequently, both parties agreed to resolve their disputes involving the civil complaint.

Also Thursday, commissioners will consider Lucas’ request to extend the time period in which to record a final subdivision map for the Traditions Village 2 tentative subdivision map. The map was approved May 2, 2019, for 101.12 acres and is planned for 195 single-family residential lots on 75.86 acres with four remainder parcels northeast of Nevada Station Parkway and north of the U.S. 50/Traditions Parkway intersection in Dayton.

The project’s applicant, Susan Pansky of Project One, a representative for Lucas, seeks an extension until May 2, 2025, due to the slowing of the housing market and a continued focus on Traditions Village 1.

The commission also will hear a presentation and proclamation declaring April as Child Abuse Prevention Month, recognize Lyon County Deputy Derek Daniel with a lifesaving award and provide possible approval of critical labor shortage designations for the county’s building inspector and plans examiner positions.

The meeting takes place at 9 a.m. Thursday in the Lyon County Administrative Complex, 27 S. Main St. in Yerington or can be viewed online.
